These terms and conditions (the “Agreement”) govern your access to and use of the services provided by Nova Speech Clinic (the “Clinic”) through our website, therapy services, and other professional services. By accessing or using our services, you (the “Client” or “Participant”) agree to comply with and be bound by these Terms and Conditions.
Please read these Terms and Conditions carefully before using our services.
1.1 Services Provided
Nova Speech Clinic offers speech pathology services, including assessments, therapy sessions, and related services. These services are provided by a certified practicing speech pathologist (the “Therapist”).
1.2 Eligibility for Services
Services are available to both individuals and groups as per the requirements of their individual needs. The Clinic may provide services under the National Disability Insurance Scheme (NDIS), Department of Veterans Affairs (DVA), Medicare, and other funding sources as applicable.
2.1 Booking Appointments
Appointments can be made via phone, email, or our website. You are responsible for ensuring that all the information provided is accurate.
2.2 Late or Missed Appointments
If you miss an appointment or arrive late, we may not be able to provide the full service, and you may incur a cancellation fee or reduced service time. See our Cancellation Policy.
3.1 Fees
All fees are in accordance with the pricing schedule available on our website. Prices may change based on updated NDIS Price Guides or other regulatory changes. You will be informed of any price changes with adequate notice.
3.2 Payment Methods
Payment can be made by credit card, direct debit, or as per your funding arrangement with NDIS, Medicare, or other providers. Payment terms will be confirmed at the time of booking.
3.3 Self-managed NDIS Participants
If you are self-managing your NDIS funding, you are responsible for making payments directly and submitting Payment Requests to receive funds from your NDIS plan. Payment must be made within seven days of receiving an invoice.
3.4 Plan-managed NDIS Participants
For those using a Plan Manager, the Clinic will send invoices directly to the Plan Manager for payment. If your Plan Manager does not pay within seven days, you will be responsible for paying the outstanding balance.
4.1 Cancellations
If you need to cancel or reschedule an appointment, you must notify us at least 48 hours before the scheduled session. Failure to provide 48 hours’ notice will result in a 50% cancellation fee.
4.2 No-Show
If you miss an appointment without providing prior notice, you will be charged the full session fee.
4.3 Late Cancellations
If you cancel an appointment within 48 hours of the scheduled time, a 50% cancellation fee will apply.
4. Serious Circumstances
In the case of serious circumstances (such as medical emergencies or unforeseen events), cancellation fees may be waived at the discretion of Nova Speech Clinic.
4.5 Waiting List
If you miss more than 4 consecutive appointments or cancel a significant portion of your scheduled appointments, you may be reassigned to the waiting list.
5.1 Confidentiality: All information provided to the Clinic will be kept strictly confidential and only shared with relevant parties with your consent or in accordance with the law.
5.2 Data Collection and Use: We collect personal information from you to provide therapy services, and we comply with the Privacy Act 1988 (Cth). For more information, please refer to our Privacy Policy.
5.3 Record Retention: We retain clinical records in compliance with legal requirements. These records will be securely stored and may be shared only when necessary (with your permission or if legally required).
6.1 Honesty and Accuracy
You agree to provide accurate and complete information to the Nova Speech Clinic regarding your or your child’s health, history, and therapy needs.
6.2 Respect
You agree to treat Nova Speech Clinic staff with respect and courtesy. Any form of abuse or inappropriate behaviour will result in the cancellation of services.
6.3 Attendance
It is your responsibility to attend scheduled appointments on time. If you are unable to attend, you must notify us in advance.
7.1 Termination by Client
You may terminate services by providing written notice at least two weeks in advance. You will be liable for payment of any outstanding balances due at the time of termination.
7.2 Termination by Nova Speech Clinic
We reserve the right to terminate services if there is failure to pay for services or if there is inappropriate or abusive behaviour towards staff. In such cases, you will be liable for any services rendered up until the termination.
8.1 Limitation of Liability
Nova Speech Clinic will provide services with due care and skill in accordance with Speech Pathology Australia (SPA) Professional Standards. However, the clinic does not guarantee any specific outcomes or results from the therapy services provided. While we strive to deliver the highest quality of care, therapy outcomes may vary depending on the individual needs, circumstances, and engagement of the client.
8.2 Indemnification by Client
You agree to indemnify, defend, and hold harmless Nova Speech Clinic, its employees, agents, and affiliates from any and all claims, liabilities, damages, losses, costs, or expenses (including legal fees) arising from:

We may update or modify these Terms from time to time to reflect changes in our services or legal requirements. Any changes will be communicated to you, and continued use of our services or website after changes indicates your acceptance of those updates.
10.1 Jurisdiction
These Terms and Conditions are governed by and construed in accordance with the laws of Australia, with specific reference to the laws of Queensland. Any disputes arising under or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of Queensland, Australia.
